Privacy Policy

1. Who we are

Profitwize (“we”, “us”, “our”) is a partnership registered in England and Wales, at Suite 1-3 Westminster Buildings, Theatre Square, Nottingham, Nottinghamshire, NG1 6LG. We are registered with the Information Commissioner’s Office (ICO) under registration number ZC199096, and we are the data controller for the personal information described in this policy.

We help UK businesses check whether they may be owed money because of undisclosed energy-broker commission, and where appropriate we introduce them to a claims management company whose panel of SRA-regulated law firms may pursue a claim. We are an introducer; we are not a law firm and we do not give legal advice.

2. What this policy covers

This policy explains what personal information we collect, how and why we use it, who we share it with, how long we keep it, and your rights. It applies to our website (profitwizeclaims.com) and to any other way you interact with us.

3. The information we collect

Depending on how you deal with us, we may collect:

  • Contact and business details: your name, business or trading name, company registration number, email address, phone number and role.
  • Energy account information: your energy supplier, meter numbers (MPAN/MPRN), approximate contract dates, consumption data, and copies of your energy bills and contracts.
  • Correspondence: messages you send us and records of our communications with you.
  • Claim information: information about your potential or actual claim, including updates we receive from the law firm handling it.
  • Register-of-interest details: if you ask us to keep your details for a possible future service (for example for smaller claims), the contact details you provide for that purpose.

We do not generally seek special category data (such as health information). Please do not send us sensitive personal information unless we specifically ask for it.

4. How we collect it

  • Directly from you: through our website forms, the eligibility check, WhatsApp, email, phone or post.
  • From the law firm and claims company handling your claim: for example, case-progress and settlement updates (see section 6).
  • From your energy supplier: where you have given a signed authority allowing your records to be requested.

5. Why we use your information, and our lawful bases

We use your information for the purposes below, relying on the lawful bases shown:

  • To respond to your enquiry and carry out a preliminary eligibility check. Lawful basis: your consent, and our legitimate interests in assessing and responding to enquiries.
  • To introduce you to the claims management company and its panel law firm, and to pass them the information needed to assess and run your claim. Lawful basis: your consent.
  • To receive and act on case-progress and settlement updates from the law firm. Lawful basis: our legitimate interests as the introducer, and where relevant your consent.
  • To hold your details if you register interest in a possible future service. Lawful basis: your consent. We keep these details only so we can contact you if that service becomes available, and you can withdraw at any time (see sections 7 and 8).
  • To meet our legal and regulatory obligations. Lawful basis: legal obligation.
  • To improve our services and website. Lawful basis: our legitimate interests, and for non-essential cookies your consent.

Where we rely on legitimate interests, we have weighed them against your rights, and we will give you more detail on request.

6. Who we share it with

To provide our service we share your information with:

  • The claims management company we introduce you to, and the SRA-regulated law firm on its panel that assesses or runs your claim.
  • The law firm as your claim proceeds, and, as the introducer, we may receive case-progress and details of any settlement back from them.
  • Our professional advisers and service providers (for example IT and communications providers) who process information on our behalf under appropriate agreements.
  • Regulators, authorities or other third parties where we are required to do so by law.

We do not sell your personal information, and we do not share it with the utility-switching or third-party marketing partners referred to on our previous website.

7. How long we keep it

We keep your information only for as long as we need it:

  • Enquiries that do not proceed: we keep basic enquiry details for 24 months and then delete them.
  • Claims that proceed: we keep information relating to your claim in line with the law firm’s retention requirements, typically up to six years after the claim concludes, to meet legal and financial-record obligations.
  • Register-of-interest details: we keep these until the future service launches and we have contacted you, or until you ask us to remove them, whichever is sooner, and in any event no longer than 24 months without re-confirming your consent.

8. Your rights

Under UK data protection law you have the right to: access the information we hold about you; ask us to correct inaccurate or incomplete information; ask us to delete it; object to or restrict our processing; ask us to transfer it (data portability); and withdraw your consent at any time where we rely on consent.

To exercise any of these, contact us using the details in section 1. You also have the right to complain to the ICO (ico.org.uk; helpline 0303 123 1113), although we would ask you to raise any concern with us first so we can try to put it right.

9. Where we hold your information

We hold and process your information in the UK. Some of our service providers may process data outside the UK; where they do, we make sure appropriate safeguards are in place, such as UK-approved standard contractual clauses.

10. Cookies

Our website uses cookies. Essential cookies are needed for the site to work and cannot be switched off.

We also use analytics cookies to understand how the site is used. These are only set with your consent, which you can manage through our cookie banner or your browser settings.

11. Changes to this policy

We may update this policy from time to time. The current version is always on this page, with the “last updated” date shown above.
